Article 24 [Education]

This chapter examines Article 24 of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) on Education. The CRPD is the first human rights treaty to contain an express reference to "inclusive education" which is considered a means to make the universal right to education effective for persons with disabilities. The chapter begins by charting the drafting history of Article 24 with a focus on "inclusive education" which was a much-debated issue during negotiations. Then, the right to education and the right to "inclusive education" are analyzed in the framework of international law. The chapter further considers the normative content of Article 24 and how the CRPD Committee has interpreted this provision. It also explores the obligations of the Parties in terms of reasonable accommodation, support measures and accessibility and the interactions of Article 24 with other substantive articles of the CRPD. Finally, it focuses on some good practices concerning the domestic implementation of Article 24.
