abstract:
This paper aims to provide a picture of the current division of environmental competences,
analyzing the constitutional case law on this subject in the light of the doctrinal debate that has concerned the
search for the legal notion of environment, since the theoretical approach adopted conditions the extension of the
competences of the two levels of government. The intention is also to give an account of the effective distribution
of environmental competences also thanks to other aspects, such as regional legislative production and
constitutional litigation, which provide clear elements in the sense of the multilevel perspective of the
environmental discipline and the role that the principle of loyal collaboration could play.
