abstract:
An element of continuity between the reform of the Italian Constitution dedicated to territorial autonomies (2001) and the constitutional review started in this legislature lies in proposing again a clause to favor for the special administrative regions and the autonomous provinces of Trento and Bolzano. The previous reform, increasing the powers and functions of the regions, has found application in melius also to the special autonomies, while the new reform, which would intervene in a reductive way on those same powers, would apply only to the ordinary regions. We try here to take stock on the concrete application of the current most favor clause before considering, in light of this experience, the possible new minor disadvantage clause, if we may so call it.
