Contenuto e confini di "vecchie" e "nuove" materie in evoluzione: l'agricoltura, la pesca, la caccia e l'alimentazione

With the reform of Title V of the Italian Constitution, the terms "agriculture", "fishing" and "hunting" disappear from the text of the art. 117: they don't appear in the lists of State powers, either exclusively or concurrently. The most logical conclusion that the doctrine immediately reached was that these matters belonged to the "residual regional jurisdiction", as the Constitutional Court soon confirmed on the occasion of several rulings. Different question for "nutrition", a term that instead appears in the Constitution, for the first time, on the occasion of the same Reform, among the matters of concurrent competence between the State and the Regions. This paper aims to reconstruct, also through constitutional jurisprudence, the content and boundaries of these matters, the points of contact and the possible interference with State competences of a concurrent and exclusive nature and, finally, analyzes the regional legislation produced in these matters from 2001 onwards in order to understand the extent of the substantial contents of the subjects themselves.
