The regulations on electronic signature is an ideal theme statement, to highlight the issues concerning the general and widespread phenomenon of harmonization of national law with Community. The legal framework for electronic signature encoded by the Code of digital administration of Public Sector (Decree 7 March 20005, n.82), develops some complexities regarding harmonization because of the deep differences that characterize the spirit of the law and Directive Community-EU 1999/93. The idea of electronic signature in accordance with national legislation which legitimizes the existence of rigid and reliable instruments for citizen privacy of the relationship with the Public Sector, will inevitably be opposed to the EU more closely to see into more simple, less rigid, with the answer to modern needs
