On the basis of the analysis of the context and of the actual conditions of the legal provisions, the aim is to evaluate the current impact of the legislation about administrative simplification on entrepreneurial activity and, in particular, to verify whether it constitutes a brake or a factor of economic development. The verification of the first research hypothesis starts from the assumption that the implementation of administrative simplification requires a phase of deepening the knowledge base. To this end, the first step involved the analysis of national legislation aimed at reducing the bureaucratic requirements for carrying out production activities and the opinions of some experienced entrepreneurs, also at international level. The 'anti-bureaucracy' laws and regulations are numerous and even pervasive, but they produce a paradox whereby a mass of provisions instead of facilitating the identification of the regulatory content complicate its understanding, leading operators to adopt prudential behaviour instead of directly implementing the norm. On the basis of the above-mentioned assumption, we proceeded to the elaboration of alternative proposals for the implementation of the principles and values underlying administrative simplification, with a view to removing the obstacles to development, through the exploration of solutions compatible with the outlined regulatory framework, or rather of de iure condendo possibilities, directed to an effective and real implementation of administrative simplification, starting from the proposal for the revision of the management and control system within the Public Administration.
