La dottrina giuridica e la sua diffusione

The idea of this volume was born in May 2015, following the interest shown in a seminar held in Rome at the National Research Council, under the title: "La banca dati DoGi - Dottrina Giuridica infrastruttura documentaria del CNR per il diritto". The purpose of the meeting, organized by the Institute of Legal Information Theory and Techniques (ITTIG-CNR), which produces and manages the DoGi database (a bibliographic reference database of articles published in Italian legal periodicals), was to present the current situation and the future prospects of this information source which from the Seventies of the last century bears witness to the evolution of the Italian legal doctrine (in particular the articles published in legal journals) and has now received a new impetus after its recognition as a CNR's documentary infrastructure. The seminar was also an opportunity to discuss the new approaches to access legal doctrine and to focus on important development prospects for the enhancement of legal bibliographic information. The volume collects both the papers presented in Rome (chs. I, VII, XI-XV) and additional insights, elaborated by other authoritative Italian and foreign experts who accepted the invitation to offer their contributions (chs. IV-IX). Also included is the Italian translation of two interesting works published in recent years (chs. II and III), with the view of enriching the volume with differing cultural contexts and perspectives that come together in a unitary reflection path. Finally, we included a paper already published in 1976 on the origins and the first years of the DoGi database (ch. X). The result is a work divided into three sections. The first, entitled "Jurists and legal doctrine", is about exploring the role, boundaries and the position of legal doctrine in the academia and in the legal system. The second section, "Access to legal doctrine: experiences and perspectives", addresses the present and future of accessing legal doctrine, with particular reference to the new perspectives for developing ways and tools for disseminating an increasingly rich and varied information source. The third section, "A case study: the DoGi - Dottrina Giuridica database" analyzes the DoGi service and its potential, also on the basis of different types of users of legal doctrine (academia, professionals, institutions, citizens...). This volume arises from the idea to reflect on the meaning and value of legal doctrine as it is today, and to compare issues related to the contribution it provides to the creation of law and to the ways through which it is spread and is made accessible. Our hope is, moreover, according to our research interests, that the works collected here provide evidence of the importance of confrontation and exchange between law scholars, on the one hand, and scholars in the field of legal informatics on the other. We strongly believe that the sharing, from different perspectives, of the interest on the nature, role, and methods of legal doctrine and on its dissemination and access can positively contribute to the current debate on these issues.
