abstract:
The sharing economy is a model for sharing activities and their respective products or services based on an exchange system that is partly unrelated to the dynamics of the traditional market. A recent example is, inter alia, Uber. Its legal nature still appears controversial, yet official and unofficial positions are multiplying throughout Europe in favor (few) and against (many) a new deregulated business. The contribution deals with the state of legislation and jurisprudence and proposes a legal-economic interpretation of the phenomenon.
