The article is a short comment on the Judgment No. 708 of 19 October 2018 of the Tribunal of Fermo by which the Tribunal upheld case law on war crimes and State immunity from jurisdiction in line with decisions issued in the Decision of the Constitutional Court No. 238/2014 and Decisions of the Court of Cassation No. 15812/2016 and No. 762/20172015.
