La consuetudine commerciale nell'Ottocento italiano

The author focused on the study of the relationship between custom and legislation and on the theoretical construction of custom in the italian legal doctrin of the nineteenth century, also studying the thought of some interpreters of the crisis of the system of "Ius commune" (which preceded the whole process of codification). On the second aspect he focused on the study of the influence of "Scuola storica del diritto" and "Pandettistica" on the subjective element of custom.
