The paper aims to analyse the Italian Council State judgment n. 2019/2270. The Italian Council State addressed for the first time the use of algorithms and artificial intelligence for the timing of administrative measures that affect citizens' rights. It clarifies the conditions under which it is possible to use automated decision-making processes within administrative procedures. The ethical use of technology does not constitute a new problem. In the case of a sudden and impacting technological development, such as the development of the AI-based products, the problem assumes greater importance. The idea is to create a new culture for artificial intelligence through a design incorporating the principles of democracy, the rule of law and fundamental rights.
