Abstract:
This research analyses how mutual recognition in criminal matters interferes with the rights of the individuals concerned and how these legal instruments are applied in Italy. Regarding mutual recognition, the study is limited to the Framework Decision on the European Arrest Warrant , the Framework Decision on Transfer of Prisoners (FD 2008/909) and the Framework Decision on judgments and probation decisions (FD 2008/947). With regard to the rights of individuals, this research particularly focuses on the Charter of Fundamental Rights of the European Union (CFR), Directive 2012/13/EU on the right to information in criminal proceedings, Directive 2013/48/EU on the right of access to a lawyer in criminal proceedings and Directive 2010/64/EU on the right to interpretation and translation. The study combines a legal analysis of the above legislation with an empirical study.
